Page title: Terms and Conditions · Shopify slug: terms-of-service

1. Scope

(1) These Terms and Conditions ("Terms") govern all purchases made through the online shop at virexo.com between the operator of virexo.com (hereinafter "VIREXO", "we", "us") and the purchaser (hereinafter "you", "Purchaser"). Our catalogue covers goods in the home and garden categories.

(2) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that lie predominantly outside their commercial or self-employed professional activity. A business purchaser is any natural or legal person, or partnership with legal capacity, who acts in the exercise of their trade or independent professional capacity at the time the contract is formed.

(3) Any deviating, conflicting or supplementary general terms submitted by the Purchaser shall only form part of the agreement where their applicability has been expressly confirmed by us in writing.

2. Contracting Party and Contact

The purchase contract is concluded between you and the operator of VIREXO. Full provider details are available on our Legal Notice page.

3. Conclusion of Contract

(1) The listing of our home and garden goods in the online shop does not represent a legally binding offer; it serves solely as a non-binding online catalogue.

(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to purchase the goods held in your shopping basket.

(3) Acknowledgement of receipt and acceptance of your order are despatched simultaneously — you will receive both immediately after submitting your order by means of an automatically generated email. Upon despatch of that confirmation email, the purchase contract becomes legally binding.

(4) We retain the contract text and send it to you together with these Terms by email. The Terms currently in force can be consulted at any time at virexo.com/terms-of-service.

(5) Contracts are concluded in the English language.

4. Prices and Shipping Costs

(1) All prices shown on the website are inclusive of the applicable statutory Value Added Tax. Any delivery charges are presented separately during the checkout process.

(2) For shipments to countries outside the European Union and the United Kingdom, customs duties, local taxes and further levies may apply; these are the sole responsibility of the Purchaser.

(3) Full details of delivery charges and estimated shipping windows are set out on our Shipping & Payment page.

5. Payment Terms

(1) The following payment methods are accepted: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude individual methods in specific circumstances.

(2) The full purchase price is due upon conclusion of the contract.

(3) Where payment is made by credit card or PayPal, your account will be charged immediately upon completion of the order.

6. Delivery

(1) Goods are sent to the delivery address supplied by the Purchaser. The applicable delivery windows are displayed on each product page and throughout the checkout process.

(2) Should delivery prove impossible after three attempts, we are entitled to withdraw from the contract. Any amounts already paid will be refunded to you without delay.

(3) Where force majeure causes a delay, the delivery period shall be extended proportionately. We will inform you of any such development as swiftly as possible.

7. Retention of Title

All delivered goods remain our property until the full purchase price has been received.

8. Right of Cancellation for Consumers

Consumers are entitled to a statutory right of withdrawal. Full cancellation details and the model withdrawal form are available on our Cancellation Policy page.

9. Warranty and Liability for Defects

(1) The statutory provisions on defect liability apply. For consumers, the limitation period for defect-related claims is two years from the date of delivery.

(2) For second-hand goods, this period is reduced to one year from the delivery date.

(3) Should any item arrive in a defective condition, please contact us at contact@virexo.com.

10. Liability

(1) We accept unlimited liability in cases of intent and gross negligence, and within the framework of applicable consumer protection legislation.

(2) In cases of ordinary negligence, our liability is restricted to breach of a fundamental contractual obligation — one whose fulfilment is indispensable to the proper execution of the contract and upon which the Purchaser may legitimately rely. In such circumstances, liability is capped at foreseeable, contract-typical loss.

(3) Liability for injury to life, limb or health remains unaffected by the foregoing.

11. Dispute Resolution

(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

12. Applicable Law and Jurisdiction

(1) The contractual relationship is governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as the protection conferred by mandatory provisions of the consumer's country of habitual residence is not thereby withdrawn.

(2) Where the Purchaser is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered office shall have exclusive jurisdiction over all disputes arising from this relationship.

13. Final Provisions

Should any provision of these Terms be or become wholly or partially void, the validity of the remaining clauses shall not be impaired. The relevant statutory rule shall substitute any invalid provision.
